This article assesses the role of Immanuel Kant’s ideas in the historical philosophy of Gustav Shpet (1879—1937). This theme has been largely ignored by Shpet scholars who have concentrated on comparing his logical-methodological theories with the ideas of representatives of phenomenology (E. Husserl, R. Ingarden and others) and hermeneutics (F. Schleiermacher, W. Dilthey, H. Lipps, H.-G. Gadamer and others). Accordingly, the authors consistently reconstruct “the sphere of conversation” within which Shpet’s concept of “historical philosophy” was formed and reveal the place (...) and role of Kant’s ideas in Shpet’s theories (with particular focus on the Plato-Kant antithesis). Among Shpet’s “interlocutors” with whom he discusses Kant and thus “ploughs” the field of historical philosophy are G. I. Chelpanov and E. Husserl, B. Bolzano and A. Trendelenburg, F. Heman and M. Frischeisen-Kohler. We have attached Shpet’s notes on Kant in the archive of his family. Shpet’s attitude to Kant was controversial (while of course largely critical) and yet he was aware that Kant was the foundation of European philosophy and that his efforts to resolve the epistemological problem merit a second, thorough examination and a retracing of the path followed by Kant. The authors show that Shpet’s notes on Kant have more than historical-philosophical relevance. They enable us to take a new look at many theoretical and cognitive problems and, even more importantly, make us rethink the fundamental tenets of philosophy and the methodology of scientific cognition. In the Transcendental Aesthetic (TA), Kant is typically held to make negative assertations about “things in themselves,” namely that they are not spatial or temporal. These negative assertions stand behind the “neglected alternative” problem for Kant’s transcendental idealism. According to this problem, Kant may be entitled to assert that spatio-temporality is a subjective element of our cognition, but he cannot rule out that it may also be a feature of the objective world. In this paper, I show in a new (...) way how Kant’s view (focusing on his conclusions about space) is not subject to this objection, by showing that he does not make the denial about mind-independent reality that he is typically held to make. The argument develops consequences of a new reading of Kant’s expression “an sich selbst” (‘in itself’; ‘in themselves’). I argue that “an sich selbst” or “per se” has a special, judgment-level role, so that this expression does not form new noun-terms adjectivally. It follows that the conceptual unit of Kant’s “Conclusions” in the TA is simply “things” (Dinge), since “things in themselves” is not a nominal expression; Kant adopts the Wolffian ontological use of “thing” as the basic kind-term for any existent. The arguments that things per se are not in space are arguments that space cannot be a necessary property or relations of things as a kind. I show that this does not involve the positive claim about mind-independent reality that inspires the neglected alternative objection. (shrink)

In this paper we elaborate on the question how to bridge the gap between contemporary (New) music and the tradition of the past, often called ‘classical’ music. First we analyze the notion of tradition (in classical music) as being distinct from traditional music, nationalism and traditionalism. A central role in this paper is dedicated to the role of counterpoint education following J.J. Fux’s Gradus ad Parnassum in the development of Central-European classical music between the late Renaissance and late Romantic periods. (...) The developments in the 20th century New Music reveal several important trend breaks. The controversies raised during the early Renaissance, regarding the practice of polyphonic singing, are discussed with respect to their impact on music development in later ages. From these controversies and the re-discovery of Nicholas de Cusa’s view on mysticism, the experience of the non-experience in polyphonic music is elucidated. Herewith, an illuminative heuristic is found in the enfolding-unfolding paradigm both in music and pictural arts, from the Renaissance till the present. (shrink)

This paper argues that the impact of individual higher education institutions’ strategies on system diversity should be explored. By looking at how universities respond strategically to governmental policies as well as to the actions of other (competing) institutions, our understanding of determinants of diversity can be enriched. A conceptual framework focusing on institutional positioning is explained using the dimensions deliberateness of organizational actions versus environmental influence, on the one hand, and differentiation versus compliance, on the other. We posit institutional positioning (...) as the mechanism through which organizational and environmental levels are linked. Our model features multiple dimensions and relations reflecting how higher education institutions locate themselves in specific niches, i.e. positions where they are able to gather the necessary resources for their core activities. The implications for research on diversity and for policymaking are discussed. (shrink)

:This article reexamines the “prostitution objection” to paid surrogacy, and argues that rebuttals to this objection fail to focus on surrogates as embodied persons. This failure is based on the false distinction between “selling one’s reproductive services” and “selling one’s body.” To ground the analysis of humans as embodied persons, this article uses Kant’s late ethical theory, which develops the conceptual framework for understanding human beings as embodied selves. Literature on surrogacy commonly emphasizes that all Kantian duties heed to the (...) categorical prohibition to treat persons as mere means. What this literature leaves out is that this imperative commands us more specifically to engage ourselves and others as embodied persons. This article aims to relate this point to a specific issue in assisted reproduction. It argues that a Kantian account of human beings as embodied persons prohibits paid surrogacy on exactly the same grounds as it prohibits prostitution. (shrink)

Asperó and Schindler have completely solved the Axiom [Formula: see text] vs. [Formula: see text] problem. They have proved that if [Formula: see text] holds then Axiom [Formula: see text] holds, with no additional assumptions. The key question now concerns the relationship between [Formula: see text] and Axiom [Formula: see text]. This is because the foundational issues raised by the problem of Axiom [Formula: see text] vs. [Formula: see text] arguably persist in the problem of Axiom [Formula: see text] vs. (...) [Formula: see text]. The first of our two main theorems is that Axiom [Formula: see text] is equivalent to Axiom [Formula: see text], and as a corollary we show that Axiom [Formula: see text] fails in all the known models of [Formula: see text]. This suggests that [Formula: see text] actually refutes Axiom [Formula: see text]. Our second main theorem is that the [Formula: see text] Conjecture holds assuming [Formula: see text]. This is the strongest partial result known on this conjecture which is one of the central open problems of [Formula: see text]-theory and [Formula: see text]-logic. These results identify a fundamental asymmetry between the Continuum Hypothesis and any axiom which is both [Formula: see text]-expressible and which implies [Formula: see text], on the basis of generic absoluteness for the simplest of the nontrivial sentences of Third-Order Number Theory. These are the [Formula: see text]-sentences with no parameters. Normative case studies are designed to offer richly detailed “worlds of possibility” that invite complex reflection and discussion about authentic ethical dilemmas in education. In this essay, Tatiana Geron and Meira Levinson argue that authors' choices of what details to include in a case are themselves ethical decisions that require significant ethical responsibility. Case details can shape which avenues of ethical inquiry are open to readers, whether and how institutional and structural conditions get considered, whose perspectives are included and (...) legitimized, and what political issues are understood as “open” or “closed.” At its best, case “world-building” can help readers understand the full complexity of ethical decision-making in education. However, for this to occur, case authors must seek out expert and dissenting perspectives, field test the case with diverse audiences, and remain reflexive about their own perspectives and how these shape their world-building decisions. The Hyperuniverse Program is a new approach to set-theoretic truth which is based on justifiable principles and leads to the resolution of many questions independent from ZFC. The purpose of this paper is to present this program, to illustrate its mathematical content and implications, and to discuss its philosophical assumptions.

The new industrial paradigm Industry 4.0, or smart industry, is at the core of contemporary debates. The public debate on Industry 4.0 typically offers two main perspectives: the technological one and the one about industrial policies. On the contrary, the discussion on the social and organizational effects of the new paradigm is still underdeveloped. The article specifically examines this aspect, and analyzes the change that workers are subject to, along with the work organization, smart digital factories. The study originates from (...) an empirical survey conducted by the author together with a multidisciplinary research group between 2014 and 2015 in some of the largest Italian factories.In particular, the article analyzes the links between digital society, digital culture and Industry 4.0, focusing on the issue of people’s participation in the process of change, within a specific case study from the railway sector.Many elements of the Industry 4.0 paradigm are widespread outside the factory, in society; they are not only technological elements but also cultural. One of the key aspects of the analysis is the question of participation and the “person-centered” culture. The subject is addressed critically by presenting both the RE-personalization processes and the new processes of DE personalization caused by digital automation. (shrink)

The present study aims, on the one hand, to reflect on reading practices within the university library, describing and explaining the various possibilities and their connection with the purpose of university education, and on the other hand to demonstrate as an extra reading activity teaching at the academy – a reading group – can provide meaningful reading experiences for those involved. To this end, the study develops a theoretical reflection, based on a literature review, which highlights the contributions of literary (...) reading and reading groups in an academic context to the dynamics of lifelong learning. Then, interviews with participants in a reading group, carried out in a university library, are analysed, seeking to explore the impact of the experiences declared in this area on their daily lives. It is concluded that the reading groups assume themselves as an essential strategy to promote literary reading and learning transversal skills, namely academic skills based on critical reflection, orality and relational interaction, revealing, at the same time, the intertwining the reading hared with the daily lives of each of the participants, which goes beyond life in the gym. The study leaves clues to an extensive field of reflection and action. (shrink)

In the paper the joint Logic of Proofs and Provability is presented that incorporates both the modality □ for provability 287–304) and the proof operator tF representing the proof predicate “t is a proof of F” . The obtained system naturally includes both the modal logic of provability GL and Artemov's Logic of Proofs . The presence of the modality □ requires two new operations on proofs that together with operations of allow to realize all the invariant operations on proofs (...) admitting description in the modal propositional language. ABSTRACTIn the United States, constitutional and statutory law reinforce the right of all children to receive an education, regardless of their citizenship or immigration status. In a time of heightened anti-immigrant sentiment and law enforcement, however, partnerships among school districts, local law enforcement, and the U.S. Departments of Justice and Homeland Security subject undocumented and unaccompanied minor students to indefensible levels of risk for detention and deportation. We identify three stances that U.S. schools may take in the face of a (...) potential ‘school-to-deportation pipeline.’ Schools that engage in intentional collaboration actively increase detention and deportation by referring students to immigration officials for criminal, non-criminal, and even non-disciplinary activity. Schools that engage in predictable complicity may not intend to subject their undocumented and unaccompanied minor students to detention or deportation, but still put students at risk by involving police in school policies. We argue that U.S. schools should instead engage in proactive protection of immigrant students and families, including actively resisting federal policies when necessary. (shrink)

This article aims to make public part of the research on the concept of ‘light’ in the theological and, above all, liturgical tradition of the Greek Orthodox Church, based on its representation of the concept of ‘hypostasis’. Taking as a point of departure the interpretation of the expression ‘light of light’ [φῶς ἐκ φωτός (phôs ek phōtos)] of the text of the Niceno-Constantinopolitan Symbol, the article presents a proposal for the interpretation of the concept of ‘representation’ for this specific case, (...) based on the idea of apomímesis, and applies this concept to a reading of the place of ‘light’ in the Holy Scripture, in the Patrology and in the Greek Eastern Liturgies. In this paper, we attempt to de-naturalize the prevailing economistic imaginary of work that Max Weber and later commentators described as ‘protestant work ethic,’ epitomized in the figure of homo economicus. We do so by contrasting it with the imaginary of skillful work that can be found in vignettes about artisans in the Zhuangzi. We argue that there are interesting contrasts between these views concerning 1) direct goal achievement vs. indirect goal achievement through the cultivation of skills; 2) the hierarchization (...) of mental versus physical dimensions of work; 3) the crafting of non-dominating relationships between the working subject, their object, and their instruments of work, which leads to questions about the sustainability of these relationships; and 4) the relationship between work and well-being, which the Daoist texts conceptualize in a much more holistic, but also more presentist way than Western economic rationality. We conclude by pointing out the relevance of these differences for several contemporary debates about work, by denaturalizing a dominant imaginary of work, by distinguishing different forms of work, by suggesting a different relation between work and nature, and by raising questions about the desirability of the automation of work. The article explores court forms as an interactive genre essential for legal-lay communication in civil and family proceedings: court forms elicit key information from predominantly lay users for the purposes of court administration and the judiciary. The information presented in court forms defines the agenda and communicative focus of the subsequent hearings and settlement negotiations, and in some instances even the path the proceedings would take. It is thus important to consider court forms in terms of their comprehensibility as well (...) as functionality for eliciting legally coherent narratives and facilitating efficient engagement of lay participants with the proceedings. The case study presented in the article draws on the combination of corpus linguistics and discourse analysis to explore two versions of the court form most frequently used by self-represented parties in England and Wales, ‘Form C100: Apply for a court order to make arrangements for a child or resolve a dispute about their upbringing’. The comparison of the paper form and its redesigned online version identifies the improvements made as part of the digitisation process but also indicates communicative challenges which can prevent the lay person from presenting the relevant information. The discussion provides an opportunity to reflect on the role of language in online courts. (shrink)

Revisiting the generally accepted notion of psycho-physical parallelism in Spinoza, Chantal Jaquet offers a new analysis of the relation between body and mind. Looking at a range of Spinoza's texts, and using an original methodology, she analyses their unity in action through affects, actions and passions.

As part of the response to the COVID-19 pandemic, many jurisdictions across the world introduced remote hearings as an alternative way of continuing to offer access to courts. This practice-based article discusses the report prepared by the author for a judicial review case which revolved around the claim that in immigration settings the quality of interpreting conducted in fully online hearings is inferior to interpreting in face-to-face hearings. In the absence of pre-existing research comparing the impact of the physical and (...) fully online settings on interpreting, the author’s expert witness report explored linguistic principles governing conversation and turn-taking management, power relations and narrativisation and discursive practices in online and physical settings to illustrate communicative advantages and disadvantages of each environment. The article draws on the investigations conducted for the expert witness report and pursues the following aims: (1) reflect on the role of linguistic expertise required for the case; (2) detail the conclusions drawn and recommendations endorsed in the report; (3) discuss the importance of effective communication in immigration settings; (4) challenge common misconceptions in relation to how narratives are elicited, shared and perceived; (5) explore safeguarding strategies for enhancing discursive practices in fully remote hearings in order to improve non-native speakers’ access to justice. Este artigo tem o objetivo de apresentar e desenvolver as críticas feministas à Teoria da Justiça de John Rawls, especialmente por meio do diálogo e das contribuições de Martha Nussbaum e Susan Okin para um liberalismo feminista. Para tanto, discutimos três pontos centrais no debate entre essas duas filósofas feministas e Rawls: a) a noção de família como uma instituição básica da sociedade; b) a distinção entre doutrinas morais abrangentes razoáveis e não razoáveis; e c) a concepção de pessoa política (...) com autonomia plena. As críticas à teoria rawlsiana feitas por feministas demonstram a riqueza e a profundidade de Rawls para o liberalismo contemporâneo, ao mesmo tempo em que apontam para os problemas que teorias que tradicionalmente não desenvolvem um olhar crítico para a situação generificada dos sistemas democráticos encontram ao abordar a situação da cidadania das mulheres. As demandas do feminismo liberal, relacionadas à situação de mulheres ao redor do mundo, são muito bem-articuladas por Nussbaum a partir de sua crítica interna ao liberalismo rawlsiano, enfatizando que algumas das disposições teóricas desse autor não parecem ser radicais o suficiente para garantir a disponibilidade integral dessas capacidades para mulheres e crianças. Da mesma forma, o diálogo de Nussbaum com as críticas de Okin aprofundaram o debate sobre os limites da teoria da justiça rawlsiana. (shrink)

This article examines public communication about atomic energy as an important vector in the political, institutional, and technological transformations of Ukraine's nuclear industry since the breakup of the USSR. It explores the ongoing effort to make the atom more domestic, familiar, human, and accessible against the not-so-distant backdrop of the Chernobyl nuclear disaster in 1986. The central focus of this article is the analysis of children's drawings of nuclear power stations produced for art contests organized by local nuclear information centers. (...) These contests and other activities of the centers have contributed to the increased visibility of nuclear power in Ukraine. The drawings reveal the inscription of the atom into complex representations about the Ukrainian nation, its past, present, traditions, and modernity. The analysis of these drawings as well as government and nuclear power station (NPP) documents, press articles, and interviews indicates that the notion of the “domestication” of the atom is a particularly appropriate way to describe the banalization of nuclear technologies in Ukraine. The relevance of the topic of research of humanitarian capital as a set of values of social sciences today plays an exceptional role, because human capital is a great character and its goal is the process of mastering the world through the development of humanistic knowledge and methods of cultural education, aimed at personality formation. The Central problem for modern conditions is management education with a view that human capital formed by all humanist-oriented sciences, must be directed to the development (...) and fulfillment of personality. The main task of higher school is the identification, preservation and effective use of human knowledge as a set of humanistic values, which together constitute the human capital needed to ensure a comprehensive and creative personality. The article explains the essence, objectives and main directions of human capital with the aim to form comprehensive and creative personality, based on cultural development of man as his self-development and self-actualization. Objectives of the study are the conceptualization of human capital as a set of humanitarian values, which are implemented in practice of educational process of higher school. The methodological basis for the formation of humanitarian capital in the information society is a synergetic methodology aimed at revealing the intellectual and creative personality, which incorporates all the values of the Humanities, presented by specific synergistic tools. Conclusions – management of education in modern conditions should be directed on formation of mechanisms of human capital as a set of values created by mankind and implemented by social sciences and disciplines.
